Property Division
Massachusetts is an equitable distribution state. This means that marital property, as well as marital debts, are divided equitably, but not necessarily 50-50. Real property, homes, personal property, pensions, employee stock options, 401(k)s and other types of assets may be subject to division.
Spousal Support (Alimony)
Sometimes called alimony or spousal maintenance, spousal support is the amount of money that is paid from one spouse to the other. Though not all divorce cases involve spousal support, it may be awarded in certain situations. The courts consider a variety of factors when determining the amount of spousal support to be paid, such as the length of the marriage, ages of the parties, and income-earning potential of each party.
Child Custody
The type of custody that is ordered by the court is to be in the best interests of the child or children. Judges take other factors into consideration, but the child’s health and well-being govern the entire child custody arrangement. Physical custody is usually granted to one parent in a divorce while legal custody may be held jointly. However, physical custody can be joint as well, though this is not as common as sole physical custody.
Child Support
Child support is determined by following state-set guidelines and entering numbers, such as the income of each parent, into a formula. The calculations are then used to establish the amount of child support that is to be paid each month.
