If I could share only one piece of advice about credit card debt, it would be this: do not try to pay off your credit card bills with other assets before speaking with an experienced bankruptcy lawyer. Do not tap into your retirement savings. Do not take on a second mortgage. Do not do anything to alter the character of your debt before you see me.
Bankruptcy is very effective at getting rid of unsecured debt — credit card bills, medical bills, utility bills or any other bills that are not attached to an asset.
For example, if you take out a second mortgage to pay off your credit card bills, you now have debt that is tied to an asset. In addition, if you empty out your 401(k) to pay credit card bills, you are letting go of money that would have been protected in a bankruptcy to pay off debts that could have been discharged. You were saving that money for your future, and there is no way to get it back.
Although you might be doing these things with the best of intentions, you could be making serious and costly mistakes.
