How Bankruptcy Can Make Your Mortgage Affordable Again
Some people assume that filing for bankruptcy will cause them to lose their house. Generally, the opposite is true. The two forms of bankruptcy can help in different ways.
A Chapter 7 bankruptcy eliminates unsecured debt like credit card or medical bills. However, you may find that without those unsecured debts hanging over your head, you are in a much better position to make your house payments. If you cannot afford your house payments because of other crushing debts, Chapter 7 might be the solution for you.
A Chapter 13 bankruptcy can help you catch up on payments that you have missed due to a period of unemployment or disability. If you are employed now and able to make your house payments, but do not have the resources to pay off your delinquent debt, Chapter 13 might be the solution for you. Even if you have already received a foreclosure notice, this option can often be used bring you out of foreclosure with a reasonable payment plan for your missed payments.
While each type of bankruptcy offers a unique solution for making your house payments, they have one thing in common. Either type of bankruptcy will put an automatic stop to a foreclosure sale. At a minimum, it gives you a chance to put together a plan to save your home. This is part of the automatic stay protection provided by section 362(a) of the Bankruptcy Code.
